Rezime:
Lišenje slobode predstavlja zakonom predviđenu mjeru društvene reakcije u obliku kazne i drugih vrsta krivičnih sankcija koje se sastoji u oduzimanju slobode kretanja učinioca krivičnog djela za, u sudskoj presudi, određeno vrijeme. Međutim, pozitivno zakonodavstvo Republike Srbije poznaje i druge (posebne) oblike lišenja slobode koji nisu posljedica sudske odluke ili učinjenog krivičnog djela. Tako, posebne oblike lišenja slobode predviđa i Zakon o bezbjednosti saobraćaja na putevima. Naime, primjenom zakonskih ovlaštenja licu koje upravlja motornim vozilom u javnom saobraćaju - vozaču, iz zakonom propisanih razloga, za određeno vrijeme se može oduzeti sloboda kretanja. To nije krivična ili prekršajna sankcija, ali predstavlja jaku preventivnu mjeru kako bi se spriječilo da takvo lice za određeno vrijeme upravljajući motornim vozilom u javnom saobraćaju ugrozi i prouzrokuje posljedice za ljude i materijalna dobra. O pojmu, karakteristikama, uslovima i načinu primjene, te vremenu trajanja lišenja slobode učesnika u javnom saobraćaju govori se u ovom radu.

Abstract:
Deprivation of liberty is a legally prescribed measure of social reaction in the form of fine and other types of criminal sanctions consisting of deprivation of freedom of movement of criminal offense perpetrator for a certain period of time specified in the court judgment. However, positive legislation of the Republic of Serbia is familiar with other (special) types of deprivation of liberty which are not a result of a court decision or committed criminal offence. Thus, the specific forms of deprivation of liberty are provided by the Law on Road Traffic Safety. Namely, by applying a legal authorizations, a person driving a motor vehicle in public traffic - the driver, may be deprived of freedom of movement for a certain period of time and on the basis of legally prescribed reasons. This is not a criminal or petty offence sanction, but a strong preventive measure that prevents such a person from driving a motor vehicle in public traffic for a certain period of time and, thus, causing certain consequences and endangering persons and material goods. This papers is about the concept, characteristics, conditions and way of application and duration of the deprivation of liberty of a participants in public traffic.
