FINANCING THE SAFETY OF LOCAL COMMUNITY TRAFFIC AFTER AMENDING THE LAW ON THE BUDGET SYSTEM

Rezime: Zakonom o bezbednosti saobraćaja na putevima (u daljm tekstu: Zakon) regulisano je obezbeđivanje sredstava za finansiranje unapređenja bezbednosti saobraćaja. Izvori sredstava za ove namene mogu biti: iz budžeta, od naplaćene kazne za saobraćajne prekršaje i drugo. U skladu sa Zakonom, sredstava od kazni za saobraćajne prekršaje raspoređuju se: 70% budžetu Republike Srbije i 30 % budžetu lokalne zajednice i namenski se koriste za unapređenja bezbednosti saobraćaja na putevima. Međutim, izmenama Zakona o budžetskom sistemu, koji se primenjuje od kraja 2015. godine, kao sistemski zakon, stavlja van snage odredbe Zakona iz njegove nadležnosti i prihodi od kazni za saobraćajne prekršaje postaju opšti prihod budžeta. Promena tretmana ovih sredstava može da stvori problem kod finansiranja nadležnosti lokane zajednoce propisane Zakonom. Treba imati u vidu da je samo u 2016. godini budžetima lokalne zajednice od kazni za saobraćajne prekršje raspoređeno 1.386 miliona dinara. To zahteva veće angažovanje koordinacionih tela za bezbednost saobraćaja na lokalnom nivou da zadrže namenu ovih sredstva. Posebno, ako se ima u vidu izveštaj Državne revizorske institucije krajem 2016 godine, u kome je navedeno da primena Zakona u praksi nije zaživela u više od trećine reviziranih lokalnih zajednica u 2015. godini.

Abstract: The Law on Road Traffic Safety (hereinafter: the Law) regulates the provision of funds for financing the improvement of traffic safety. Sources of funds for these purposes can be: from the budget, from the penalty imposed for traffic violations and other. In accordance with the Law, funds from fines for traffic offenses are allocated: 70% to the budget of the Republic of Serbia and 30% to the budget of the local community and are deliberately used to improve the safety of road traffic. However, the amendments to the Law on the Budget System, which is applicable from the end of 2015, as a systemic law, supersedes the provisions of the Law under its jurisdiction and revenues from fines for traffic offenses become the general budget revenue. Changing the treatment of these funds can create a problem with the financing of the competencies of local communities prescribed by the Law. It should be noted that in 2016 only 1,386 million dinars were allocated to the local community budget from fines for traffic violations. This requires greater engagement of the local transport safety coordination bodies to maintain the purpose of these funds. In particular, given the report of the State Audit Institution at the end of 2016, in which it was stated that the implementation of the Law in practice did not take place in more than one third of the audited local communities in 2015.
