Rezime: Putni prelazi, kao mesto ukrštanja dve vrste saobraćajnica (pruga i put) i dva vida saobraćaja (železnički i drumski), generiše rizike u odvijanju kako železničkog tako i drumskog saobraćaja. Ovi rizici su veći zbog činjenice da na 3808 kilometara javne železničke infrastrukture na teritoriji Republike Srbije (bez putnih prelaza na industrijskim kolosecima i industrijskim železnicama) imamo 2138 putnih prelaza ili da na jednom kilometru javne železničke infrastrukture imamo nešto manje od dva putna prelaza. Osnovni zadatak nadležnih državnih organa je da kroz normativnu regulativu urede ovu oblast u cilju svođenja rizika na putnim prelazima na prihvatljiv nivo. Da bi se to postiglo propisi moraju da budu precizni, jasni i usklađeni. Rad se bavi pregledom propisa, kako zakonskih tako i podzakonskih, koji uređuju pitanja održavanja i korišćenja putnih prelaza na teritoriji Republike Srbije od strane zainteresovanih subjekata. Takođe se bavi i pregledom osnovnih obaveza za upravljača javne železničke infrastrukture i upravljače puteva koje su proistekle iz propisa koji uređuju oblast putnih prelaza.

Abstract: Level crossings, as a crossing point between two types of traffic (rail and road), generate risks in traffic flow of both rail and road traffic. These risks are even higher due to the fact that along 3808km of railway public tracks on the the territory of Republic of Serbia (not including level crossings on industrial railways), there are 2138 level crossings or little less than two level crossings per each kilometer. The main task of the competent national authorities is to regulate this field through regulatory rules in order to lower the risks on level crossings to an acceptable level. To achieve that, regulatory rules must be exact, explicit and to accord with one another. This paper gives a review of the regulatory rules, such as laws and bylaws, which regulate the maintenance and the use of level crossings on the serbian territory by interested parties. It also deals with the review of basic obligations of the public railway and road managers.
